On 27 April 2016, the European Parliament and the EU Council adopted the General Data Protection Regulation ((EU) 2016/679 – GDPR), on the protection of natural persons with regard to the processing of personal data and the movement of such data, applicable from 25 May 2018.
With the entry into force of this regulation, the process began of implementing provisions that comprehensively and uniformly regulate the function of the Data Protection Officer (DPO). This will strengthen data protection for all individuals in the EU, regardless of where the data is located. The GDPR sets higher standards of protection than the previous legislative regulation on the same matter.
Although the Republic of Macedonia is not a member state (holding candidate status since 2006), it is in the country's fundamental interest to align its national legislation with the aforementioned EU legislation. Toward this end, a new draft Law on Personal Data Protection has also been prepared.
The most important developments arising from the GDPR (relevant also for the Republic of Macedonia) are:
- revised transfer of personal data to countries outside the EU
- new rights for data subjects and new methodologies for ensuring GDPR compliance
- increased role and responsibility of supervisory authorities and similar measures
